Compensation for Elite Service

Do you think we deserve compensation for the Elite Service, taken directly from Elite Terms

 

  • EXCLUSIVITY OF REMEDY  To the extent permitted by applicable law, if you have purchased an annual Premium Membership, you are unable to receive the Service due to an outage caused by a fault on the part of Activision, and Activision’s failure to provide the Service to you continues for more than 48 consecutive hours, then you shall receive, as your sole and exclusive remedy, compensation for each full 48 hour period that you are unable to receive the Service. The compensation shall be in any form chosen at Activision’s sole discretion and valued at approximately 2/365th of your annual Premium Membership Fee for the year in which you are unable to receive the Service for at least 48 consecutive hours. Notwithstanding the foregoing, under no circumstances shall the aggregate amount of your compensation in a year exceed the Annual Service Fee. Notwithstanding the foregoing, you will only have the right to receive compensation if you notify Activision (via the Customer Support number listed in Section 25.7 above) within five (5) days of your inability to receive the Service, and (ii) your inability to receive the Service is for reasons other than (a) your actions or omissions or those of any other person or entity other than Activision; (b) your equipment, or any other equipment, internet connectivity or service not provided by Activision; (c) planned Service maintenance periods; or (d) any circumstances or events beyond Activision’s control (see also Section 23 above).

 

 

So from their own terms and conditions, Activision state we will recieve compensation from them if the service is not available for more than 48hrs, currently we are nearly 3 months in, and in my eyes the service is still unavailable what do you think?

    Yeah, but did you call the activision number?

    Unfortunately, this section of the TOC has to do with if the entire site is down and you are unable to log on or view it.  The free month that all premium members received back in December was due to this and the fact that no one could access the site right after launch.  However now, the site is functioning (In its limited capacity) and persons are receiving (what little bit of miscalculated stats) the service, attempting to get compensation via this path will lead to failure.

     

    You can take a look at Activision's profile on the Better Business Bureau website and see that hundreds of people have filed complaints related to Elite.  However each and every complaint has been researched and closed in favor of Activision.  They still have an A+ rating.  I have come to the conclusion that Elite was not designed by software or Web Designers, it was designed by Lawyers.

      every complaint hasnt been solved and closed.. my complaint is still open and active.. Activision has only replied once to acknowledge the problem.. not to fix it.. and im taking 2 hours of dbl xp as compensation...

       

      im already 10th level 80 anyways..

       

       

      Clan operations were suppose to be active on day one to premium elite members.. its now almost 3 months into the service and still no clan operations as it clearly states in the premium FAQ's..  that is my complaint and thats what i filed about

    "It was our fault that the service wasn't up and running the day [fans] put in their token or the day they bought it," Activision's Daniel Suarez, VP of production told me. With the worst of the launch nightmare seemingly behind them, Beachead's goal now is to have everything up and running by or before the 30-day mark, since that's the length of the complimentary service extension premium subscribers received as a "make good" gift for the launch week shortfall.#

    "They kind of have to bear with us while we bring this all back up, but for us it's literally 'Give us those couple weeks, we're giving those to you for free and come December 1 the goal is that we'll have everything up and running.'"

    At this point I'm not even mad or upset about the missing features anymore.  As long as I get my DLC then I'll be happy.  If Clan Ops ever starts working then great.  If not then no big deal.  Elite is a lost cause.
