Call of Duty Elite age restriction????

I live in New Zealand and MW3 has a rating of R16 and i am 16. So i legally purchased the hardened edition of MW3 and then i get told after i have bought it that Call of Duty Elite has an age restriction of 18????? how is this fair? im legally allowed to buy the game but have wasted my money because IW made a dumb age restriction on Elite and didnt tell anyone about it untill after heaps of people with the same problem as me have already wasted their money.....

wtf is it with everyone on here? You say to the under 18's they should read the T&C first. Tell me do you read ALL of the the T&C before you buy anything? Have you read them on any game you have bought? did you read them for this game? most likely not. Rules enforced as heavily as this, that effect the majority of people that buy the game should be unmissable on the front cover of the hardened box and on the market place/psn store.
You know what really gets me lol, someone who is 16 can join the army and go through the real deal, but can't play a 100% safe simulator. We are in one crazy ****** up world.
I actually do read Terms of Services and Codes of Conduct so I don't screw myself over. You're telling me you don't read them? So you're agreeing to something and you don't know what you'r agreeing to?

The retailer from whom I purchased the content from did not advise me of the age limit/restriction. They also will not refund/exchange any downloadable content. It's just sounding a bit shady. Also, in my case, it appears to be an X-Box Live account issue. Terms of Service apparently don't match with Activision, so it's "apparently" Not entirely Activision's fault.
Currently on hold with BOTH X-Box Live & Activision support and waiting for "live chat" on Activsion support site...
This WILL BE RESOLVED to my satisfaction.
It's not an XBL issue.
It is an Activision issue.
Their policy.
Their servers.
Not being advised by the retailer is a retailer issue.
There is nothing in the XBL TOS about Activision games (nor EA games for that matter).
It's dumb, but most american companies are pretty ignorent of the rest of the world.
