Heres what is going on, as of now Clan Emblems are unlocked on Xbox for sure, not sure about PS3. As of now the only way to earn an emblem is by leveling up as said on the clan unlocks list. But, if you are past a level to unlock an emblem you must wait, they will be awarding them soon.... hopefully. One way I know to get emblems right away is to level your clan to an emblem unlock level. After this past clan op, my clan reached level 39 and we were instantly given the emblem. So, starting now, get to the next level with an emblem to get it and wait for the ones your clan is past in the leveling to be awarded to you by Infinty Ward/Beach Head/Sledgehammer or whoever is doing it.
