They are not going to break the contract so its not worth all this time if you ask me. Now that I know that the Contract ends in 2012 thou I suggest Activision thinks of a new way to make the money from the Xbox contract and make DLC Content available for all at the same time. Maybe a extra dollar or two added onto each map pack would make up and solve problems and alot of bitter comments. Im sure there is a way to make this all right in the next COD game so all will get DLC at the same time and Activision still make there extra millions another way instead of a check from xbox. Who konws maybe a deal with sonys! IM SURE Sonys bank account is just as big, maybe its our time to shine.

Unfortunately game dev companies appear to have a habit of being tight-lipped on such issues, that is, we hear little or nothing until the problem is corrected. Probably because if they open their mouths about remedies and such remedies dont work out then the shite really hits the fan.

@djxtc I believe your best angle to work would be, individually with a small claims action as anyone purchasing elite was pre-paying for a product/service that
1). was not complete or usable when purchased
2) you were pre paying for content to be released to you in increments at a future date.
therefore, you the purchaser entered into a contract with activision/beach head and because you had no usable product/service at that time, activision/beach head contract should have stated dates or approximate dates when that product/service was to be delivered. and if there was to be different dates for different consoles this should have been disclosed, especialy as you were paying in advance.
And to get (as I said in my earlier post) as many people in different locations to file an action. Using this angle, you all or some of you may win. This would then set a precedence.
I'm not familiar with the Canadian competition act (as im not in Canada) but even if you would obtain a judgement (chances are slim as the case would be big enough for them to have a very highly qualified legal team) and for the sort of money you are talking about. The case woud be tied up for years in court and then more years in appeals and no one would gain anything apart from the lawyers. Keep it simple, with a proven method.

@IslandGo4R re Sony's sales. Remember "Turnover is vanity, Profit is sanity!! Sony are feeling the pinch currently. In 2008 their shares were nearly $60 they are now trading at $18 and it doesnt look good. Where as microsoft are trading around £30 and have been pretty solid.

Third year Activision has came under fire. It all started with Kotick's statement that gamers will buy anything and all you gotta do is repackage.
I think someone is going to succeed at taking them down.

Most of what you said is true but like so many others you cannot read correctly. At no time did I read that CGO was a federally run organization. What was said was that the CBC was a federally run organization and they would be the ones to persue a suit. CGO is just trying to bring the mistreatment of gamers to light. Which if you were a gamer would support.

I think you're referring to the Competition Bureau of Canada. CBC (Canadian Broadcasting Corporation) is our federally run broadcaster, but both do have the same acronym. I had to read that a few times, lol. If you're not Canadian I can see how that can be mixed up. The Broadcaster CBC has actually covered some of our efforts:
