How to get a Refund for Elite this ONLY APPLIES TO UK / XBL

Right just got off the phone to xbl,
I have been refunded my 4000ms points and they are cancelling my subscription to elite.
as you know theres been a few of us who've now gotten refunds in the last few days well heres my story hope it helps others
I spoke to them at great length about the whole elite issue and they I was told they have been "inundated" (thier words) with unhappy callers especially since the dlc hit and the complaints from unhappy people now stuck with a locked dlc, and completely agreed with me that the advertised services that were part of premium elite were not available as advertised. It does strike me as a testament to the failure of elite that xbl who are infamous in refusing refunds are doing so in this case..
So if you want a refund call 0800 587 1102 its a free phone number and select the billing option think its number 4

Explain that under uk law you have given the service the required 30 days plus to make good on their contract, and they have failed to deliver on any advertised premium features, and mention the fact the dlc is locked to one specific gt and the usage policy says the opposite..

Depending how you paid depends on what refund you will get... I will explain it exactly how they explained it to me.. if you paid by credit card there are more than happy to refund the payment and cancell the sub, BUT if you paid via ms points theres an issue as normally ms points are set in stone and they do not refund points back, I explained that the points would still be used to buy the dlc in march as i need the dlc to work on all gt's on my xbox, their answer was under the circumstances and due to the time i have been with xbl ect they were happy to refund the points back as a goodwill gesture as they could see I only added the 4000 points to buy elite. still technically im out of pocket as i bought a prepaid card for the points but im sure ill either buy some of the actual dlcs for mw3 if the the original policy is used and if not well theres some pretty decent games on xbla i should try me thinks
This only applies to the uk/european players, but im sure if the americans were to explain to us xbox support their collegues over in euroland are refunding people they might be more likely to agree too..cant promise anything though as i said in other posts we have much better consumer rights over this end of the world than you guys have.
so there you go.. yes you can get a refund for elite now is the time to speak with your wallets virtual or otherwise if like me you are entirely dissatisifed with the elite service .
also sorry ps3 users this is xbox related not sure if you guys have the same recourse as us, but given the number of unhappy posters from the ps3 boards im thinking you guys have the same rights as us if not more just depends on psn's customer service team.
oh and as i know theres always those doubters out there... screenie of my points statement as you can see 4000ms points were adjusted back in today ![]()

germany should be same as uk as the consumer laws are european wide

I am presently in protracted discussions with Activision Support regarding either getting more compensation than just the one months subscription everybody received (which they have declined) or a full refund. Problem is I got Elite by buying the hardened edition, they have referred me back to where I bought it and the online retailer have refused to provide me with a full refund. I am now arguing that Activision need to either arrange the full refund or just refund me for the subscription.
Based on the level of customer service I feel I have received over the past few years in relation to the CoD franchise I am not expecting anything to come of these discussions, but hey they have my money so alls well and good for them.

totally agree here the he elite subscribers are entitled to some form of worthy goodwill gesture by Actvision imo, as most people bought mw3 HE solely based on the failed promises of elite.

take note ask for supervisor as call centre staff cant access systems to refund yet the supervisor can.
as i say 46 mins but it takes some persuding but stick to maccs line of under uk law ect and you will be refunded

I hate to say this but "Lone Star the President" didnt say it. It was that old general that said it ![]()
Unfortantly I will be doing the same. I have said nothing bad about this game but my opinion on Elite is different. The same thing that I use it for I could do with the free. No clan operations, my tablet is not tied into a radio network so the app won't run, the videos and events are just plain bad and goofy to watch.
I enjoy the game but Elite is a fail.
I do not enjoy only being able to play with Elite members if I want to play the new maps. The old way was better. Everyone should have the maps at the same time. Why should I have to restrict myself to playing with only premium members to play these maps? I know that it is a "perk" to play the maps "early" but it is not an early release. This is the same time that Black Ops had maps come out for everyone. It is punishment for people who didn't want Elite.
Elite is not working and has not worked yet. Everything that Elite offers was free in blackops from the MP in the game and actually had better stats recorded than MW3.
You may like Elite. For me it has not lived up to the hype and I don't think it will at this point.
I must say that macc might be wrong on the credit card thing
i bought ms points and bought a service they promoted, they said go to activision for a refund
i said i cant spend ms points with actvision, xbl refunded me

did you buy points direct from xbl?
i bought mine from a retailer in town and just added the code hence couldnt get the money refunded only the points, i did say in original post they would have refunded the money to credit card had i purchased my points that way.
tbh im happy with the result id rather have 4000msp sitting in my account than know activision have my money for elite. if the dlc in march has the usual usage policy of any user then ill happily buy the dlc again if the other two maps are alot better than lib and pissashitta

I started this process last month (year), but since I am a Hard-on guy, I have to go through Activision. Initial customer support could not help me and said a "supervisor" would contact me shortly. 36 days later, nothing. I have called back twice (since I had a support ticket open) and gave them my reference #, but I am not getting any type of answer out of ACTIVISION.
Sucks to be me. But Macc, you have once again inspired me to push along with this process again.

I thought I would bump this again, just to keep it fresh for those who are looking for an answer. I also think that it's important for people to know that even MS thinks this whole situation is worth a refund.
MS is the major platform for Activision's product, and they think the prodcut is flawed. Wow. Activision, how are you not dealing with this?
I got Elite refunded last week. First I emailed COD's support and they told me that xbox has to handle that, which is BS if you ask me, they are the one's who screwed up. But anyways, I just called xbox support and spoke to a guy, we talked about how great Batman: AA is, lol and 20 put me on hold a few times and I just explained to him in a polite manner that Elite is a rip off, I've been on Xbox live for 6 years and never once asked for a refund on anything and I deserve one here because it's $50 and it doesn't hold any value what so ever. He mentioned the map packs, but I told him that map packs don't do me any good if the lag prevents me from enjoying the game online. I went through the advertised parts on Elite's website like a checklist and explained how each and everything they advertised doesn't do that at all, it's worthless.
Then I got my 4000 ms points back, I'm happy with that. I recommend others do the same.
That was a LOW move on IW's part, very low, I'll never support that company again in my life.
Wow, I am happy for you guys that got your money back, that is great. It is a shame the consumer laws in the US are not as good as the UK. I wish someone could get some changes done for the US consumer laws so we don't get ripped off too.

They won't give you a refund after you already have 4 months of dlc.

Not in any way saying that Macs lying. I am 100 percent positive he got a refund on Elite.
The case he brought up was quite possibly for Clan ops not working when it was promised and quite possibly passed the 30 day rule.
It could also be a factor of many things that gave him a refund.
I can say from Experiance all the way up the line , in the US you cannot get a refund on Elite because it violates XBL policy that yu agreed to.
now if it didnt work at all. no problem.
I don't think Mac is lying at all. I'm sure he did get his refund. But this thread is from January. However I don't see them giving anyone a refund in April after they have received have their DLC and they have been able to complete in Clan Ops. From my POV Elite is 100% operational right now.
