They have the right to do that in their own home (or maybe in your country, in public), but in a private space owned by a company, they have to abide by Terms or Conditions of Service. Swastikas, genitals etc. are prohibited. End of story.

I'm also a little tired of people rolling out the notion that free speech is a "right". It's about time people started realising it's a privilege. One not enjoyed by a great many inhabitants of this planet. It should be cherished as such, not abused by ignorance.

I know that I have to tolerate the right of people to be a nazi, racist, etc., in the public domain and support that proposition. In the "real world," I support the rights of expression and association and people should have the right to be nazis, etc., if they so chose (although I dislike them). I am a firm believer in the first amendment. However, x-box live is like a private club in which its members have to pay for admission. It is not a public place although it does have many members. Because it is essentially a gaming club solely intended for all members to have fun, there should be some reasonable, objective, limits as to conduct that affects the rights of others to enjoy their $60.00 admission price that they paid to join.

Lastly, I do NOT believe that either Activision/Treyach supports racists, etc. However, if they intend to to have a universal appeal which in turn is of course, more profitable, they would be well advised to not permit a minority of players to intentionally offend or attempt to intimidate others.

When I have played late at night, in particularly, I have encountered many emblems and weapons with swastikas and anti-semitic names and racist ones as well. As a Jewish person who lost relatives in the 1940s, I consider those to be "fighting words." I did not pay the x-box live membership fee or COD purchase price to be insulted or angered and do not know of many people who would.

It is one thing to have a kid draw naughty pictures etc., it is another to wear or present the symbols and use the words of people who did and still want to murder you and your family because solely of your ancestry and/or race and/or ethnicity. I do not neet to tolerate that in a private setting.

well like you said its a freedom of expression, if someone wants to show something racist, they have a right to express that, tolarance goes in both directions, not just in the tolarance of ethnicity, but also tolarating the people who may not be tolarant.

allowing someone to post something like this is not a reflection of activision, or treyarch..

i personally report emblems that show any of this if the person is running their mouth, other than that, i could care less

While I personally can tolerate depictions of body parts such as penises (although they are ugly), etc., figuring that some pimply male teenager somewhere is giggling that he drew one, on-line gaming should be for everyone, not just pimply teenagers or older idiots who think that depicting a penis will get a "rise" out of someone. The problem is that such depictions tend discourage people from playing COD such as females (many of them at least), etc. I strongly support "freedom of speech" in most instances, but COD and x-box live are pay-for-admission for services provided by a private company. Their interest is in making their services appeal to to as many people possible for obvious economic purposes. Still, one of our great freedoms is the right to be an idiot and tell the world with your emblem that you are.

What I cannot tolerate is racial or religious insults, hate speech or emblems. That is intended to anger and offend or itimidate. Playing COD is a game and should be fun. The killing in the game is make-believe. When I see Swastika's displayed, anti-semitic language, racial insults, etc., in a on-line game, it is no longer fun at all. I feel anger and the desire to pick up a real weapon instead. Gaming should never, ever involve that and those people should be banned. That type of insult or imagry, in a gaming forum, should be banned and both Microsoft and Activison should take it seriously. No doubt, neither would want a reputation as a hangout or a forum for racists, white supremacists or nazis. It would truly damage their "bottom line."

Usually i do not report penises etc. but what i do report is like nazi or 3rd reich emblems because they do really offend me! Penises or somewhat are "ok" in my opinion...its an 18+ game so i dont see the problem with penises or boobs or somewhat! And for all of you that are like yea he probably got a penisemblem too....no i dont and i never will

Lol. Let me get this straight... You're 34 years old right? You also claim you have a bank account with 7 figures in it. That's at the very least 1 million dollars. Couple that with paying for a house and 4 cars with cash, cost of raising kids, and whatever rent you were paying before you bought said house. Do you HONESTLY expect anyone to believe that when you yourself said you make between 40 and 100k a year? The numbers don't add up brah. For arguments sake lets say your job paid you the 100k every year. You're only 34. How many years could you have possibly had that job? 12-13 years assuming you got it right out if school? With all that taken into consideration that's 1,200,000-1,300,000 dollars earned. Minus the million you say you have in the bank and we are left with 2-3 hundred thousand. You bought a house and 4 cars for that little? C'mon man! We haven't even considered the income tax you've had to pay. You're so full of ****!

I'm with you. penis emblems are not art and it offends me. I report them all to Xbox live and the game makers. if your arguing for them as art then your a retard and deserve to start over.

I'm self proclaiming my intent to be an Emblem Police person, too, and if you don't like it, too bad. I am so tired of seeing these childish porn emblems made by children who don't even know what those parts actually look like, and I've even taken the liberty to photograph some of the worst designed ones I've ever seen. In fact, I have a partially developed website that will feature some of the best and worst Black Ops 2 emblems I've seen. As a player with almost 2k matches played, I've seen at least twelve thousand emblems ranging from best to worst, so I made a hobby Site. Bot sure if yall will check it out, but ill post the url soon. I will also post my emblem I've made here,too,later . It's currently being designed.

Ps. My apologies for any misspellings. I'm using my tablet to post here and the keyboard is laggy. (sorta like my game play since Wednesdays hotfix.

I don't have a problem with swastikas. I wouldn't personally use one because they are juvenile.

Some people here are missing the point. It is not about reporting just to be an ass or something like that or just because you got mad someone beat you. It is about reporting emblems that have absolutely no place in this game.

I for one usually just go to the leaderboard and report anything that could be offensive. Do I personally find those emblems offensive? Most of the time, no. But I also have enough common sense to realize that even though I personally dont find it offensive, someone out of the millions of players that play, WILL find it offensive because there is always that 1 person. You all have to remember that it doesnt matter what YOU make you emblem to be or represent, what really matters is the opinion of the VIEWER. That is why they have in the COC not to create anything in-game that is offensive to OTHERS.

Now you may say "It is a Mature game so if they cant handle something mature then they shouldnt play". First off, being a Mature game is not an excuse to be "immature" which is exactly what these people who are creating those emblems are being. Second, the online interaction is not rated by the ESRB but the XBLPET has come out and said that they try their best to keep the online experience a family friendly one which is why they ban so many people for offensive things in their profile or in-game.

And let me put this into more perspective for you. The first BO had SO MANY people BANNED off the emblem editor because of offensive emblems, mainly the swastika. Yet these same people took this game and did THE EXACT SAME THING AGAIN!! You cant sit there and tell me and give me that same BS excuse "well its a "mature" game. That is stupid. You know what the definition of insanity is? Doing the same thing over and over again expecting a different result. And that is what these people are doing. They keep making those emblems yet they always wonder why they get banned. There is a reporting system for emblems in place for a reason.

To those who dont see a problem with the emblems and actually think it should be fine to keep them in just because it is an "M" rated game, instead of belitting those who actually follow the rules, you should understand why they do what they do and be happy they actually have a moral code when it comes to games. The fact you belittle them for following the rules and reporting what needs to be reported just tells me that the people with the emblems are not the only immature ones around here.

To those, like me, who report emblems for obvious reasons, thank you. Thank you for following the rules and trying to keep this game clean. Do not listen to those who belittle just because they think since it is a certain game that this is not a problem. Online is supposed to be treated as a family oriented place and by doing what we are doing, at least there is some hope of cleaning the place up.

To answer your questions, NO I have NEVER smoked pot, in fact NEVER taken a drug other than what was prescribed by a doctor, and even then I don't take some of those. Also I have never drank any alcohol, either underage or since being of legal consumption age. I am 34 years old, and have had NO desire to any of those things. I don't even smoke cigarettes.

At my age I see no need to act immature, or do immature things. Even growing up I would look at my peers and wonder why they did some of the things they did. Those same peers that were popular in high school are now living paycheck to paycheck and scraping by in thier lives. I currently have a 5,200 sq.ft house on 2 acres that I paid cash for, 4 vehicles that I paid cash for, have 3 children with great moral values, and a wife that is finishing her nursing degree. I have over 7 figures in my bank account and work for myself. I work from October to March (winter months where I live) and do so from my house. In that short time I make between $40,000-$100,000 a year and I do something that I enjoy.

You may call me prude, or un interesting, but honestly I could care less. I have everything I need in life, and then some. My children will be taken care of and if my values and morals are instilled in them then their children and grandchildren will be well off as well.

Besides. It's against the policy and the developers wishes -- and I respect their wishes.

The game is considered public space, and most public spaces have restrictions against porn.

Not because people don't like porn, but because it's disruptive.

Pornographic emblems are disruptive.

Images of the Nazi-emblem are not hindu or eastern symbols.

Images of a clockwise 45 degree tilted swastika has never been recorded in any mythology or culture before NSDAP, and is solely used by neo-nazis and edgy teenage trolls.

EXCLUSIVELY.

(There is ONE exception, but in that one exception the swastika in question only constitutes one fifth of the whole symbol)

2: "Freedom of Speech / expression!"

You're free to say or express anything you want in any public space that is not owned by a private corporation.

As soon as you express yourself in a space owned by other people, you have to follow their rules -- or be subject to any penalty they or the law sees fit.

Activision and Treyarch are free to throw you out and permanently deny you access to the entire online service and all future content and updates for all their future games if you break their rules.

It's not even wrong or morally questionable on their part.

Their online service, their rules.

Your only option is to not buy their games, and use your right as a consumer to vote with your wallet.
